A Gallagher claims advocate has successfully renegotiated terms for a feature film client with a disadvantageous precedent that would limit coverage in their policy, according to the global brokerage's Advocacy in Action report.
The report, which included 17 real-life case studies, featured a production company making a feature film in Australia that was already in the process of commencing production when it found something concerning in its insurance policy, involving conditions to include a substantial increase to the premium and negative amendments to the settlement terms of potential claims.
Gallagher noted that no fewer than 12 other major film productions, which obtained cover through other insurance brokers, previously accepted similar changes to the claim conditions without question – setting an unfavourable precedent and adding to the difficulty of renegotiating terms.
However, a Gallagher claims advocate formulated a solid argument against the amended terms by working the relevant points of law and how they related to the policy. The production company's insurer accepted the arguments and agreed to the client retaining the full benefit of the policy without restrictions on its ability to make claims if necessary.
