Markerstudy Insurance Services and legal advisers HF announced that they have successfully defended against a personal injury claim made by Scott Maw, identified as “Yorkshire’s Strongest Man 2023,” in a case involving allegations of fundamental dishonesty.
The case originated from a vehicle collision on August 15, 2022, in which Mr Maw, a passenger, claimed to have sustained injuries. He submitted a claim to Markerstudy, the insurer of the at-fault vehicle, citing various physical limitations.
During medical examinations in September 2022 and January 2023, Maw reported symptoms he said restricted his daily activities, including shopping, home repairs, and bathing.
However, evidence surfaced showing that less than two weeks after the accident, Mr Maw participated in the Peak District Highland Games, engaging in physically demanding events. Documentation, including photos and videos, captured him pulling an 8-tonne tractor for 1.5 minutes, carrying 170 kg stones over 50 metres, and performing a 120 kg log press.
In May 2023, Maw also competed in “Yorkshire’s Most Powerful,” where he finished fourth, before winning the title of “Yorkshire’s Strongest Man 2023” shortly after, in an event featuring a dumbbell press, deadlift, super yoke, and other strength tests.
In court, Maw attributed discrepancies in his injury claims to misunderstandings with his medical expert and miscommunication with his legal representation. However, his expert refuted these claims, and his solicitors withdrew from representing him.
HF, acting for Markerstudy, pursued a defence of fundamental dishonesty against Mr Maw, leading to him dropping his claim and being ordered to pay £15,000 in legal costs.

“This case saw absolutely the right outcome and hopefully it will act as a deterrent to others considering inflating a claim,” Mulvoy said.
